Terms of Service for Waste Clearance Paddington

These Terms and Conditions set out the basis on which Waste Clearance Paddington provides waste collection and related services to domestic and commercial customers. By booking or using our waste clearance services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Company, we, us, our: refers to the waste clearance business trading as Waste Clearance Paddington.

1.2 Customer, you, your: refers to the individual, business, or organisation requesting and using our services.

1.3 Services: means waste clearance, rubbish removal, bulky waste collection, recycling, and any associated services we provide.

1.4 Waste: means any items, materials, refuse, junk, or rubbish that you ask us to remove, including household, commercial, and garden waste, unless specifically excluded in these terms or by law.

1.5 Contract: means the legal agreement between you and us for the provision of services in accordance with these Terms and Conditions.

2. Scope of Services

2.1 We provide waste collection and clearance services for domestic and commercial customers within our operational area. The exact services to be provided will be as described in your booking confirmation.

2.2 Our services typically include attending your premises, loading agreed waste into our vehicle, transporting it to an authorised facility, and arranging for lawful disposal or recycling.

2.3 We reserve the right to refuse to remove any waste that is hazardous, prohibited, not safely accessible, or not as described at the time of booking. This includes, but is not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, gas cylinders, and any materials classed as hazardous under applicable law.

2.4 We may decline or cancel a job where access is unsafe, where parking or loading restrictions prevent us from operating lawfully, or where the volume or type of waste differs materially from that described during the booking process.

3. Booking Process

3.1 You can request our services by telephone, email, or through any booking system we make available. When making a booking, you must provide accurate details about the property, access conditions, type and volume of waste, and any relevant restrictions.

3.2 Your booking constitutes an offer to purchase services in accordance with these Terms and Conditions. A contract is formed only when we confirm acceptance of your booking and provide a scheduled collection date and time window.

3.3 Any quotation we provide, whether verbal or written, is based on the information supplied by you. Quotations are normally given as estimates and may be adjusted on site where the actual volume or nature of waste differs from that originally described.

3.4 We may request photographs or a detailed list of items in advance to assist in providing a more accurate estimate. However, all on-site assessments are final for billing purposes, subject to your agreement before work commences.

3.5 You must ensure that an authorised person is present at the property at the agreed time to give access, confirm the items to be removed, and approve any changes to the quoted price where applicable.

4. Pricing and Payments

4.1 Our charges are generally based on factors such as the volume of waste, weight, type of materials, loading time, access conditions, and any additional services requested.

4.2 Unless expressly stated otherwise, all prices are quoted in pounds sterling and may be subject to applicable taxes, which will be clearly indicated at the time of booking.

4.3 We reserve the right to revise our pricing from time to time. The price applicable to your booking is the price confirmed at the time the contract is formed, subject to any on-site adjustments agreed with you.

4.4 Payment is due on completion of the service unless otherwise agreed in writing. We accept various payment methods, which may include cash, credit or debit card, or bank transfer. We do not consider payment to have been received until it has cleared in our bank account.

4.5 For business customers with approved credit terms, payment must be made within the period stated on our invoice. If no period is stated, payment is due within 14 days of the invoice date.

4.6 If you fail to make payment in full when due, we may charge interest on the overdue amount at the statutory rate allowed under the Late Payment of Commercial Debts legislation, and we may suspend further services until all outstanding sums are paid.

5. Cancellations and Amendments

5.1 You may cancel or amend your booking by contacting us during our normal business hours.

5.2 If you cancel with at least 24 hours notice prior to the scheduled collection time, no cancellation fee will normally apply. We reserve the right to charge a reasonable administrative fee for repeated cancellations or amendments.

5.3 If you cancel with less than 24 hours notice, or if we attend the property and are unable to carry out the work due to circumstances within your control, we may charge a call-out fee or a percentage of the quoted price to cover our costs.

5.4 We will use reasonable efforts to accommodate requests to change the date, time, or details of your booking. However, any amendments are subject to availability and may result in a revised quotation.

5.5 We reserve the right to cancel or reschedule a booking where necessary due to events outside our reasonable control, such as severe weather, road closures, vehicle breakdown, staff illness, or legal restrictions. In such cases, we will notify you as soon as practicable and offer a new appointment. We will not be liable for any consequential loss resulting from such cancellations or delays.

6. Access and Customer Responsibilities

6.1 You are responsible for ensuring that we have safe, lawful, and reasonable access to the premises and to the waste to be collected.

6.2 You must arrange any necessary parking permits or authorisations in advance where possible. Any parking charges or penalty notices incurred due to inadequate arrangements or inaccurate information may be added to your invoice.

6.3 You should ensure that the waste to be collected is clearly identified and separated from items that are not to be removed. We are not responsible for items taken away in error where they were not clearly distinguished from waste.

6.4 If we are required to remove waste from upper floors, confined spaces, or areas with restricted access, you must inform us during the booking process. Additional charges may apply for difficult access, long carrying distances, or work requiring extra time or labour.

6.5 You agree not to include in your waste any items classified as hazardous or prohibited, unless we have specifically agreed in writing to handle such materials in compliance with the relevant regulations and with a separate pricing structure.

7. Waste Handling and Regulations

7.1 We operate in compliance with applicable UK waste management and environmental legislation, including duty of care obligations, licensing requirements, and regulations relating to the transport, storage, and disposal of controlled waste.

7.2 We will transport your waste only to authorised facilities such as licensed transfer stations, recycling centres, or disposal sites. We aim to maximise recycling and recovery where practicable, but we do not guarantee that any particular item will be recycled.

7.3 Once waste is collected and loaded onto our vehicle, it becomes our responsibility to handle and dispose of it lawfully. Until that point, you remain legally responsible for the waste and for any breach of regulations arising from its condition or storage.

7.4 You must not misdescribe waste or conceal hazardous materials within general waste. If we discover such items, we may refuse to remove them, charge additional fees for safe handling, or return them to you, and we may report serious breaches to the appropriate authorities.

7.5 Where required by law or requested by business customers, we may provide a waste transfer note or other documentation evidencing lawful transfer of waste from you to us. You should retain such records as part of your own duty of care obligations.

8. Liability and Insurance

8.1 We will exercise reasonable care and skill in providing our services. However, you acknowledge that some risk of minor damage can arise during the removal and carrying of heavy or bulky items.

8.2 We are not liable for pre-existing damage to property, structures, fixtures, or fittings, or for damage that results from defects, weakness, or poor condition of your premises or belongings.

8.3 You must notify us as soon as reasonably practicable, and in any event within 48 hours of completion of the service, of any alleged loss or damage arising from our work. We may inspect the damage and, where appropriate, arrange for repair, replacement, or reasonable compensation.

8.4 Our total liability to you for any loss or damage arising out of or in connection with the contract, whether in contract, tort, negligence, or otherwise, shall be limited to the amount paid or payable by you for the relevant services, except where such limitation is prohibited by law.

8.5 We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded or limited.

8.6 We are not liable for any indirect or consequential loss, including loss of profit, loss of business, or loss of opportunity, arising from delays, cancellations, or any other aspect of the services, except where such liability cannot be excluded by law.

9. Customer Property and Title to Items

9.1 By presenting items as waste and authorising us to remove them, you confirm that you are the lawful owner of those items or have the owner’s permission to dispose of them.

9.2 Title in the waste transfers to us once it is loaded onto our vehicle, subject to any applicable waste regulations. You will not be entitled to reclaim items after collection unless we expressly agree otherwise.

9.3 We reserve the right to resell, reuse, recycle, or dispose of collected items at our discretion, provided that any such activity complies with relevant waste and trading laws.

10. Complaints and Dispute Resolution

10.1 If you are dissatisfied with any aspect of our services, you should contact us as soon as possible with full details of your complaint.

10.2 We will investigate complaints in a fair and timely manner and aim to respond with our findings and any proposed resolution within a reasonable period.

10.3 Where a dispute cannot be resolved directly, you and we may consider using an alternative dispute resolution process, although participation is voluntary unless otherwise required by law.

11. Changes to These Terms

11.1 We may amend these Terms and Conditions from time to time to reflect changes in our services, pricing, business practices, or legal requirements.

11.2 The version of the Terms and Conditions in force at the time your booking is confirmed will govern that contract. Updated terms will apply to future bookings only.

12. Data Protection and Privacy

12.1 We collect and process personal information such as your name, contact details, and service address for the purposes of managing bookings, providing services, taking payment, and handling queries or complaints.

12.2 We will handle personal data in accordance with applicable data protection laws and our internal privacy practices. We will not sell your personal data to third parties.

12.3 We may share necessary information with service partners, payment processors, or regulatory bodies where required for the performance of the contract or compliance with the law.

13. Force Majeure

13.1 We are not liable for any failure or delay in performing our obligations under the contract where such failure or delay results from events or circumstances beyond our reasonable control, including but not limited to extreme weather, natural disasters, acts of government, strikes, transport disruptions, or serious accidents.

13.2 If a force majeure event continues for a prolonged period, we may cancel the affected services and refund any advance payments for services not yet provided, subject to any reasonable costs already incurred.

14. Severability

14.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be severed from the remaining terms, which will continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 You and we agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of waste clearance services.

By placing a booking or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
